WHERE TO APPLY FOR YOUR MARRIAGE LICENSE

Marriage licenses are issued in the Recorder’s Office.
Physical address is 256 E Court, Room 20, Weiser, Idaho 83672
Office hours are Monday through Friday from 8:30 a.m. to 5:00 p.m.

It takes approximately 20 minutes for the entire process of issuing the license.
We request that you not come any later than 4:30 p.m.

A marriage in Idaho requires an Idaho Marriage License.
A marriage in another state requires a license from that state.

REQUIREMENTS IF YOU ARE OVER 18 YEARS OF AGE

• Both parties need to appear at the courthouse in person.
• Each party needs some form of photo identification.
• Each party shall provide proof of age: (Examples- Drivers License, Certified copy of Birth Certificate, Certified copy of School Records, Baptismal Certificate).
• Each party shall fill out marriage license application form.
• Each party shall list their social security number on the form.
• Read and sign pamphlet on AIDS in Recorder's Office.
• Cost: $28.00 cash

Two copies of the license are issued – one is for the couple; the other is sent or brought back to this office to be recorded.

REQUIREMENTS IF YOU ARE UNDER 18 YEARS OF AGE

• Each party under age must have a Parent or a LEGAL Guardian’s permission (consent) to marry:
• Written consent can be in person or by a notarized statement.
• Parent or Legal Guardian shall provide photo identification.
• A Legal Guardian shall provide a certified copy of the Court’s Order granting the guardianship.
• Both parties need to appear at the courthouse in person.
• Each party needs some form of photo identification.
• Each party shall provide a certified copy of their Birth Certificate.
• Each party shall fill out a marriage license application form.
• Each party shall list their social security number on the form.
• Each party shall read and sign a pamphlet on AIDS.
• Cost is $28.00 cash.

REQUIREMENTS IF YOU ARE UNDER 16 YEARS OF AGE

In addition to the above :

• The under age party shall file a Petition to Marry. (Document to be drawn by an attorney.)
• An appointment must be scheduled with the Magistrate Judge to obtain an ORDER granting permission for the under 16 year old to be married.
• A physical examination is required.

WHO CAN PERFORM THE WEDDING CEREMONY?  

A Judge, Mayor or Minister can perform the ceremony.
